Uttar Pradesh Environment Service Rules Amended: Deputy Director Post Shifted to 100% Promotion

The Government of Uttar Pradesh has announced a significant amendment to the state’s environmental service rules, drastically altering the recruitment process for the post of Deputy Director within the Uttar Pradesh Environment (Gazetted) Service. The amendment, formalised through notification no. 1532/LXXXI-6-2025 dated September 30, 2025, shifts the sole method of filling this key position entirely to departmental promotion.

The new rules, called “The Uttar Pradesh Environment (Gazetted) Service (First Amendment) Rules, 2025,” were enacted by the Governor in exercise of the powers conferred by the proviso to Article 309 of the Constitution.


Section 1: The Core Amendment to Rule 5(2)

The most impactful change is the complete overhaul of the “Source of Recruitment” for the Deputy Director position under Rule 5, sub-rule (2) of the 1995 Rules.

Recruitment Shift: From 50/50 to 100% Promotion

Prior to this amendment, the post of Deputy Director was filled through a mixed system: 50% by direct recruitment through the Commission and 50% by departmental promotion. The new rule entirely eliminates the direct recruitment quota.

The substituted rule now mandates:

5-(2) The posts of Deputy Directors shall be filled by Hundred per cent promotion from amongst substantively appointed Assistant Directors.

Eligibility Criteria for Promotion

To be considered for promotion to Deputy Director, an officer must be a substantively appointed Assistant Director who have completed seven years of service as such on the first day of the year of recruitment.

Section 2: The Retrospective Effect

A crucial detail of the 2025 Amendment Rules is its implementation date. While formally notified on September 30, 2025, the rules are endowed with a significant retrospective effect:

The rules “shall be deemed to have come into force, with effect from the 16th day of December 2011.”

This retrospective application is highly significant as it validates all promotions or appointments made since 2011 under the policy framework that aligns with the new 100% promotion rule, potentially resolving any administrative disputes related to past recruitment quotas.

Section 3: Provision for Deputation

Both the original and the amended rules maintain a safety provision to ensure continuity of service in case suitable internal candidates are unavailable for promotion. The rule provides:

Provided that if no suitable Persons are available for promotion, an officer of the Government Department, who possess the prescribed qualifications for the post may be kept on deputation until a suitable person is available for promotion.
