Details of the Amendments
Changes to Order VI
Rule 1 of Order VI will be substituted as follows:
“Pleading.— ‘Pleading’ shall mean plaint or written statement or replication.”
Changes to Order VIII
The amendments to Order VIII include two significant updates:
- The title of Order VIII will be revised to: “WRITTEN STATEMENT, SET-OFF, COUNTER-CLAIM AND REPLICATION”
- Rule 9 will be substituted with the following provisions:
“9. Subsequent pleadings, replication.— (1) The Court may at any time require a written statement or additional written statement from any of the parties and fix a time of not more than thirty days for presenting the same.
(2) The replication, if any, shall be filed within thirty days of receipt of the written statement: Provided that where the plaintiff fails to file the replication within the said period of thirty days, he shall be allowed to file the same on such other day, as may be specified by the Court, for reasons to be recorded in writing, but which shall not be later than forty-five days from the receipt of the written statement. For such extension, the plaintiff may be burdened with costs, as deemed appropriate.
(3) Where the plaintiff relies upon any document in his possession or power, in support of the replication, he shall enter such document in a list, and shall produce it in Court when the replication is presented and shall, at the same time, deliver the document and a copy thereof, to be filed with the replication.”

The High Court of Delhi is seeking public input on these proposed amendments. Objections or suggestions must be submitted in writing within a period of one month (i.e., 30 days) from the publication of the notification in Part-II, Section-I of the Delhi Gazette Extraordinary.
