Delhi Authorizes New Compounding Authority Under Drugs Law

Overview

The Health and Family Welfare Department of the Government of the National Capital Territory of Delhi has issued a new notification that formally authorizes the Controlling Authority appointed under Rule 50 of the Drugs Rules, 1945 to act as the compounding authority for offences under Section 32B of the Drugs and Cosmetics Act, 1940. This decision becomes effective from the date it is published in the official gazette.

Legal Basis of the Authorization

The authorization has been made using powers under Sub-rule (2) of Rule 3 of the Drugs and Cosmetics (Compounding of Offences) Rules, 2025. It also references the earlier Notification No. S.O.(E) 689(E) dated 25 September 1985 issued by the Ministry of Home Affairs, Government of India.

Role of the Compounding Authority

With this authorization, the Controlling Authority will now be responsible for handling compounding of offences related to drugs and cosmetics across the entire National Capital Territory of Delhi. This means certain offences under the Act can be settled by paying a prescribed amount instead of undergoing prosecution.

In exercise of the powers conferred by Sub-rule(2) of Rule 3 of Drugs & Cosmetics (Compounding of Offences) Rules, 2025 read with Notification No. S.O.(E) 689(E) dated 25th September 1985, issued by Ministry of Home Affairs, Government of India, the Lt. Governor of the National Capital Territory of Delhi is pleased to authorize Controlling Authority, appointed under rule 50 of Drugs Rules, 1945 to act as compounding authority for the purpose of the Section 32B of Drugs & Cosmetics Act, 1940 & Rules made thereunder, for the entire National Capital Territory of Delhi with effect from the date of publication of this notification in the official gazette.
